DCI is investigating

The Basin Police Department arrested an individual after a report of shots fired on South Eighth Street in Basin was taken Friday, Jan. 2 at 6:32 p.m. The investigation has since been turned over to the Wyoming Division of Criminal Investigation.

A release from Basin PD posted online at 10:31 p.m. that night relayed that all suspects had been identified and there was no ongoing threat to public safety, with the victim of the shooting transported by air to a higher level of care. During the investigation, the area of South Eighth Street and Holdrege Avenue was restricted to public access as Basin PD, Greybull Police Department, Big Horn County Sheriff’s Office, Wyoming Highway Patrol and DCI responded. Eyewitnesses reported authorities’ presence at the Bayert apartments at 803 South Eighth Street.

Cathy Bayert, who owns and lives in the apartments with her husband David Bayert, said she was not even sure the sound was a gunshot at first, thinking it could possibly have been fireworks. When police and EMS arrived, she left her apartment to learn what was going on and officials asked that everyone remain in their residence during the investigation. Officers were still on scene around midnight, when they questioned neighbors. Bayert reported the apartment’s renter was uninvolved in the shooting.

The only arrest listed on the Big Horn County Jail Roster for the night was that of Dillon McFadyen, 33, of Basin, who was allegedly involved in the shooting based on an affidavit written by Basin Police Chief Kyle McClure. McFadyen was charged with a probation violation after blowing a 0.154 BAC on a breathalyzer test and admitting to entering the bar at Lisa’s Western Cuisine and Spirits in Greybull, which he reaffirmed at his arraignment in the Circuit Court of the Fifth Judicial District in Basin on Monday.

“I apologize, I know I messed up and I’m willing to do my time,” McFadyen said.

McFadyen previously received a conviction of misdemeanor property destruction and was sentenced to six months unsupervised probation on Nov. 5, 2025. On Monday, Judge Randy Royal revoked McFadyen’s probation and ordered that he immediately serve 80 days with four days credit for time served, plus pay a previously waived $200 fine and remaining $597 in restitution and submit an updated substance abuse evaluation.

In an interview on Tuesday, McClure relayed that the victim of the shooting was in stable condition, with only the singular victim and shooter involved in the incident.  The investigation, which has been passed on to DCI, is ongoing and no charges have been filed in relation to the shooting as of press time.

Following the DCI investigation, any charges will be brought back to the Big Horn County court system. McClure noted that no timeline has been presented for that to occur.
